Dry Eye Specialists App Terms and Conditions

The terms that apply when you use the Dry Eye Specialists app on iPhone or Android.

These terms apply to the Dry Eye Specialists app (the app). By creating an account or using the app, you agree to them. If you do not agree, please do not use the app.

1. Who provides the app

The app was built with the Dry Eye Specialist Group and is provided by SynRo AB, a company registered in Sweden (organisation number 5595329805), which we call "the app provider". Your agreement for the app is with the app provider. It is not with the Dry Eye Specialist Group, your practice, Apple or Google.

  • The app provider is responsible for the app, the software behind it, your account and these terms.
  • Your member practice is responsible for the eye care you receive: appointments, examinations, treatment and fees. Each practice is its own business.
  • Apple or Google are responsible for payment, renewals and refunds for anything you buy in the app.

2. What the app is, and what it is not

The app is a self-care tool. It helps you follow the routine you agree with your optometrist, track how your eyes feel over time through your own camera check-ins, and stay connected to your practice. It is not a medical device. It does not diagnose, treat, cure, monitor or prevent any disease or condition, and the values, scores and guidance it shows are for general wellness and information only. They are not medical advice.

The app never replaces your optometrist, an examination or treatment. Talk your results over with your optometrist before making decisions about your eyes. If your symptoms change or get worse, or if you have sudden loss of vision, eye pain or a red, light-sensitive eye, contact your practice or seek urgent care.

3. Who can use the app

You must be 18 or over. By using the app you confirm that you are, and that the information you give is accurate.

4. Your account

Keep your login details private. You are responsible for what happens under your account, so tell the app provider promptly if you think someone else has used it. An account that breaks these terms may be suspended or closed.

5. Clinic codes

Member practices can give their patients a clinic code. A valid code links your account to that practice and unlocks the full app at no charge while the code entitlement is active. Codes are for patients of the practice that issued them. Please do not share, publish or resell a code. Codes that are misused, expired or withdrawn by a practice may be switched off, and the app then returns to its free version. Any subscription you bought continues under its own terms.

Your check-in results, symptom answers and plan are not sent to your practice, and your practice cannot see them in the app. To share a result, show it on your own screen at your visit. How your information is handled is set out in the App Privacy Policy.

6. Paid features, billing and refunds

  • Paid options are a monthly subscription, a yearly subscription and a single check purchase. Prices and what each includes are shown before you buy.
  • Payments are handled by the Apple App Store or Google Play under their own rules. Your card details are never seen by the app provider.
  • Any free trial and its length are shown before you buy.
  • Subscriptions renew automatically unless you cancel before the current period ends. On Apple, cancel at least 24 hours before it ends.
  • You can view, change or cancel a subscription in your App Store or Google Play account settings. The app has a link that takes you there.
  • A single check purchase unlocks one camera check and is used when that check finishes.
  • Refunds are handled by the store you bought from, under its refund policy.

7. Products shown in the app

The app shows products recommended by the Dry Eye Specialist Group, with guidance on what suits different needs. The app is not a shop and has no links to buy anything. Products are available through your practice. Follow the product's own instructions and your optometrist's advice.

8. Acceptable use

Do not use the app unlawfully or in a way that breaks these terms; reverse engineer or extract its source code except where the law allows; interfere with the app or try to reach parts of it you are not meant to; copy, republish or resell its content without permission; or use a clinic code a member practice did not give you.

9. Your content and the improvement programme

What you put into the app stays yours. You permit it to be processed as described in the App Privacy Policy so the app can work. A camera recording is sent for analysis and deleted once your result is worked out. If you turn on Help improve eye testing, you also permit your recordings to be kept and used to improve the analysis. You can turn it off at any time, and the recordings kept are then deleted.

10. Content from other companies

Learn More videos are hosted on YouTube and delivered by Google, so the YouTube Terms of Service also apply when you watch one.

11. Intellectual property

The app, its design and its software belong to the app provider. Treatment and product information from the Dry Eye Specialist Group's patient material belongs to the group and is used with permission. The group's name and mark belong to the group, and each practice's name and logo belong to that practice. You get a limited, personal, non-commercial, non-transferable licence to use the app under these terms, which can be withdrawn if you break them.

12. Availability

Features may be added, changed or removed, and the app may be taken offline for maintenance. It is not promised to be always available or free of faults.

13. Your consumer rights, and limits on liability

Nothing in these terms takes away any right you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other consumer law that cannot be excluded by agreement. Subject to those rights, the app is provided as is and as available, and the values it produces are not guaranteed to be accurate or suitable for any particular purpose. So far as the law allows, the app provider is not liable for indirect or consequential loss, or for loss from relying on the app's wellness information, and is not responsible for the clinical care a practice provides. Nothing limits liability that the law does not allow to be limited, including for death or personal injury caused by negligence.

14. Ending your use of the app

You can stop using the app and delete your account at any time. See Delete your app account and data. Deleting your account does not delete your practice's own records. Access may be suspended or ended if these terms are broken or the app is withdrawn. If a practice leaves the Dry Eye Specialist Group, its codes may end, with reasonable notice in the app.

15. Changes to these terms

These terms may be updated. The new version will be posted on this page with a new date. If a change is significant, you will be told in the app before it takes effect. If you do not agree with a change, you can stop using the app and delete your account before it applies.

16. Governing law

These terms are governed by New Zealand law and disputes are dealt with by the New Zealand courts. If you live outside New Zealand, you keep the protection of your own country's consumer law.

17. Apple and Google

If you got the app from the App Store, Apple's standard Licensed Application End User Licence Agreement applies to your licence, and these terms are in addition to it. These terms are between you and the app provider only, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims about the app, including product liability, legal compliance or consumer protection claims. If the app fails to meet an applicable warranty, you can notify Apple, which will refund the purchase price of the app, and Apple has no other warranty obligation so far as the law allows. The app provider, not Apple, is responsible for any claim that the app infringes someone's intellectual property. Your licence covers Apple devices you own or control, as the App Store Usage Rules allow. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. If you got the app from Google Play, the Google Play Terms of Service also apply.
